These Terms & Conditions (the “Terms”) apply to every purchase, commission, service, shipment and other dealing with FE GOWNORA (“FE GOWNORA,” “we,” “our,” or “us”). By commissioning a FE GOWNORA sculpture, sending us a garment, using our website, or otherwise engaging our studio, the client (“Client,” “you,” or “your”) agrees to be bound by these Terms, which also govern your use of the FE GOWNORA website. Our Privacy Policy and Website Terms of Use are incorporated into these Terms by reference.
FE GOWNORA may amend these Terms at any time and at its sole discretion, without prior written notice. Amendments take effect from the “Revised” date shown on the FE GOWNORA website. Placing an order, paying an invoice, sending a garment, ticking an acceptance box, or otherwise using FE GOWNORA’s services confirms that Client has read and accepts these Terms.
Client understands and agrees that every FE GOWNORA sculpture is a commissioned work of art, not a thread-for-thread or forensic copy of the original gown.
Because each sculpture is made individually through a combination of artistic and technical processes, small variations, adaptations, smoothing, reinterpretation and artistic decisions naturally arise in the course of production.
FE GOWNORA endeavours to preserve the overall silhouette, movement, structure and detailing of the gown, yet certain fine details may differ from the original. Such differences are not defects, inaccuracies or grounds for a refund provided the sculpture reasonably reflects the gown as interpreted through FE GOWNORA’s artistic and technical process, as judged by FE GOWNORA in its reasonable artistic discretion.
Each FE GOWNORA sculpture is a single, one-of-one commemorative object created solely at the request of the rightful owner or authorised holder of a particular gown. FE GOWNORA does not make editions, reproductions, multiples or copies of any sculpture, and does not design, stock, promote or sell sculptures apart from an individual commission. FE GOWNORA offers a commemorative service — preserving the personal memory attached to one garment for one client — and is neither a manufacturer nor a seller of garments or garment reproductions.
FE GOWNORA sculptures are independently created artistic works that combine artistic judgement, digital capture, technical reconstruction, scaling, a change of material, sculptural interpretation, engineering adjustments, digital processing and hand-finishing. The finished sculpture exists in a different medium; it is not a fabric reproduction of the gown but a distinct work produced through FE GOWNORA’s proprietary artistic and technical process. Unless expressly stated in writing, FE GOWNORA is not affiliated with, endorsed by, sponsored by or otherwise connected to any fashion designer, bridal house, couture label or garment maker.
Client acknowledges that the sculpture exists to commemorate Client’s own memories of the gown and the occasion on which it was worn, and is not intended to replicate, replace, compete with or stand in for the original garment in any market. Client further acknowledges that the sculpture’s value lies in its commemorative and artistic meaning to Client, not in any utility, function or commercial use of the original gown.
Client understands that wedding gowns and similar textiles are fragile, emotionally significant and often irreplaceable, and that they may weaken or deteriorate naturally over time as a result of age, preservation treatments, fibre content, exposure to the environment, previous wear, tailoring, cleaning, alterations or the way they have been stored.
FE GOWNORA takes great care with every item entrusted to it. Nevertheless, Client accepts that shipping, handling, scanning, steaming, styling, photography, fabrication, storage, packing and every other stage of artistic production carries an inherent risk that cannot be removed entirely, and that FE GOWNORA’s obligation is to exercise commercially reasonable care to reduce that risk.
FE GOWNORA sculptures are artistic interpretations of gowns rather than exact forensic reproductions. Although FE GOWNORA works to preserve the overall form, movement, texture and character of each gown with very high fidelity, minor differences may arise from the limits of scanning and capture technology, from scaling, from the way a particular garment and its materials behave, from production and engineering constraints, from digital reconstruction, from artistic interpretation, from hand-finishing, and from the translation of texture and surface preparation.
By placing an order, Client accepts that some variation between the original gown and the finished sculpture is inherent to the artistic and technical process, and understands that every sculpture is a work of art and not an exact fabric reproduction, as determined in FE GOWNORA’s reasonable artistic judgement.
Client accepts that slight variations in colour, texture, finish, sheen, surface, patina and hand-finishing are natural characteristics of handmade artistic works and do not amount to defects.
Photographs, renderings, earlier commissions, website imagery and marketing material are illustrative only. FE GOWNORA makes no representation that any new commission will be identical to previous work.
Client represents and warrants that:
(a) Client lawfully owns, or is lawfully entitled to hold and submit, the gown provided to FE GOWNORA;
(b) Client has the authority to commission a single, one-of-one commemorative work of art based on the gown for Client’s own personal, private and non-commercial use;
(c) to the best of Client’s knowledge, submitting the gown and commissioning the sculpture does not breach any agreement, restriction or obligation by which Client is bound; and
(d) Client knows of no third-party right that FE GOWNORA would infringe by creating a single commemorative work at Client’s request.
Client acknowledges that FE GOWNORA gives no legal advice about copyright, trademark, intellectual property or other third-party rights connected with any gown, and that Client alone is responsible for deciding whether submitting the gown is appropriate for Client’s intended purpose.
Client shall indemnify, defend (with counsel reasonably acceptable to FE GOWNORA) and hold harmless FE GOWNORA and its affiliates, officers, directors, employees, contractors, successors and assigns against all third-party claims, damages, liabilities, costs and expenses (including reasonable attorneys’ fees) arising from (i) any breach of the representations in this Section, (ii) Client’s violation of applicable law, or (iii) inaccurate or incomplete information supplied by Client. FE GOWNORA will notify Client promptly of any such claim and cooperate reasonably in its defence. This Section survives completion of the services and the ending of these Terms.
All intellectual property belonging to FE GOWNORA — its systems, methods, workflows, rendering techniques, production pipelines, fabrication systems, photography, branding and proprietary finishing techniques — remains the sole and exclusive property of FE GOWNORA.
Unless otherwise agreed in writing, FE GOWNORA retains ownership of every scan, photograph, digital capture, digital model, production file, fabrication file, engineering file and related material generated during the making of a sculpture.
Client may not copy, reverse engineer, commercially exploit or otherwise make use of FE GOWNORA’s proprietary systems without FE GOWNORA’s prior written consent. On payment in full, Client owns the physical sculpture FE GOWNORA delivers. Ownership of the physical object does not transfer any scan, digital capture, digital model, production file, fabrication file, engineering file or other FE GOWNORA intellectual property.
When a gown arrives, FE GOWNORA may record the condition of the garment and of its packaging for quality-control, insurance, operational and liability reasons. Client consents to this documentation being created and kept for operational, legal and risk-management purposes in line with FE GOWNORA’s Privacy Policy.
Such records may include:
Photographs of the whole gown
Close-up photographs of marks, discolouration, wear, pulls, tears or other existing damage
Photographs of the shipping carton and the state of the packaging
Written notes describing the garment’s condition on arrival
These records may be kept on Client’s order file. They constitute the official record of the gown’s condition on arrival and may be relied upon for insurance claims, quality control, internal records, dispute resolution and legal defence.
Client acknowledges that a gown may carry hidden weaknesses, age, staining, discolouration, brittleness, delicate fabrics, a risk of bead loss, oxidation, fragility caused by preservation, or structural instability. FE GOWNORA is not responsible for damage that results from the gown’s pre-existing condition or natural ageing, to the extent those conditions materially contribute to the damage.
(a) The Gown. FE GOWNORA supplies Client with a prepaid, insured shipping label for sending the gown to the studio. From the moment the gown is dispatched with that label, throughout the time it is in FE GOWNORA’s direct physical custody or control, and during its return journey to Client, FE GOWNORA’s total liability for verified physical loss of or damage to the gown is capped at $3,000 USD, except where the loss or damage is caused by events outside FE GOWNORA’s reasonable control or by the gown’s pre-existing condition. FE GOWNORA will settle any covered claim directly or through any insurance FE GOWNORA may hold, at FE GOWNORA’s choice. The $3,000 cap applies whatever the gown’s actual or appraised value unless Client elects and pays for additional cover under subsection (d). Cover extends only to verified physical loss or damage and is subject to verification, documentation and any carrier requirements; any amount recovered from a carrier for the same loss reduces FE GOWNORA’s payment obligation accordingly.
(b) The Sculpture in Transit. The finished sculpture travels insured through the carrier handling the shipment. FE GOWNORA declares the value of the shipment and pays for transit insurance on the sculpture; this cover is separate from, and does not count towards, the $3,000 gown cap in subsection (a). FE GOWNORA ships with carriers that provide tracking and signature on delivery and will file and reasonably pursue any carrier insurance claim for loss or damage to the sculpture in transit. FE GOWNORA’s liability for such loss or damage shall not exceed the insurance proceeds actually recovered from the carrier; where a sculpture is lost or damaged in transit, FE GOWNORA’s remedy options under Sections 9–10 (including remaking the sculpture) also apply.
(c) What Is Not Covered. Cover does not extend to sentimental value, emotional distress, the cost of replacing a wedding, event-related loss, loss of use, appreciation in market value, indirect or consequential damages, punitive damages, attorneys’ fees or personal attachment. Sentimental and emotional value are expressly excluded from every claim and from every calculation of liability.
(d) Declared Value and Additional Cover. Client alone is responsible for declaring accurately the value of any item Client asks FE GOWNORA to insure beyond the standard amounts above. If an item is undervalued, recovery may be reduced and FE GOWNORA will not be liable for any uninsured shortfall. Additional cover for the gown above the $3,000 cap may be arranged on request at Client’s expense. FE GOWNORA does not represent that any cover will fully compensate every loss.
FE GOWNORA is not responsible for damage, deterioration or change that stems from a pre-existing condition, to the extent the damage is attributable to that condition, including but not limited to fragile or weakened fabric, aged textiles, dry rot, delicate lace, discolouration, oxidation, deteriorating beadwork, loose stitching, earlier tailoring, alterations, prior cleaning, earlier preservation treatments, hidden structural weakness, material fatigue, fabric stress or natural degradation over time.
Client acknowledges that a gown sent to FE GOWNORA may be unpacked, steamed, positioned, draped, lifted, mounted on a form, photographed, scanned, prepared for scanning, moved within the studio, stored temporarily, packed and otherwise handled as part of production.
Client understands and accepts that these steps carry inherent risk, above all for gowns that are delicate, old, preserved, altered, heavily embellished or structurally fragile.
FE GOWNORA is not responsible for ordinary wear, minor structural stress or comparable effects that arise from standard handling carried out with reasonable care — for example natural fabric stress, loosening of beads, strain on stitching, slight changes in shape, creasing, compression from storage, the effect of gravity, weakening due to age, brittleness caused by preservation, or unavoidable handling impact that is part of ordinary production performed with reasonable care.
Every shipment sent by FE GOWNORA, including the finished sculpture, requires a signature on delivery unless otherwise agreed in writing. Every shipment to or from FE GOWNORA — including the gown sent to the studio and any return of the gown — requires carrier tracking and signature confirmation. Client alone is responsible for making sure an authorised person is available to receive deliveries from FE GOWNORA. FE GOWNORA is not responsible for the acts or omissions of third-party carriers except to the extent provided in Section 8.
Client alone is responsible for supplying accurate delivery details, ensuring someone is present to receive and sign for deliveries, following shipment tracking and promptly collecting any held parcel. Delivery to the address Client provides constitutes valid delivery. FE GOWNORA is not responsible for losses caused by inaccurate, incomplete, outdated or incorrect shipping information supplied by Client.
If a shipment is returned to FE GOWNORA because delivery could not be completed or Client was unable to receive it, Client bears all additional shipping charges, storage costs and re-delivery expenses. FE GOWNORA is not responsible for delay, loss or damage caused by third-party carriers except to the extent provided in Section 8.
Client must follow FE GOWNORA’s packing and shipping instructions precisely, provided FE GOWNORA has supplied or made available clear instructions.
FE GOWNORA is not responsible for damage caused by inadequate packing, insufficient padding, unauthorised shipping methods, carriers chosen by Client, failure to follow instructions, or failure to use the labels or materials FE GOWNORA provides.
Failure to follow FE GOWNORA’s shipping procedures may reduce or cancel any applicable cover.
Client must inspect every returned gown and every sculpture immediately on delivery. Any claim relating to shipping, visible damage or a delivery problem must be sent to FE GOWNORA in writing within 48 hours of delivery for transit damage and within 30 days for every other claim.
If a sculpture arrives visibly damaged in transit, Client must notify FE GOWNORA in writing, keep all original packaging, and supply photographs of both the packaging and the damaged sculpture. Late notice or failure to keep the packaging may, to the extent the law allows, forfeit eligibility for a shipping-related claim.
Where FE GOWNORA determines that damage occurred during insured transit, FE GOWNORA may, at its sole discretion, repair the sculpture, remake it, lodge an insurance claim with the carrier, or offer partial compensation.
FE GOWNORA is not responsible for damage that occurs after successful delivery — including careless handling or display, falls, knocks, accidents, exposure to the elements, improper cleaning, work carried out by third parties, or ordinary wear over time — unless the damage is directly caused by a defect present at the time of delivery. Because sculptures are delicate works of art, Client assumes responsibility for handling and displaying the sculpture appropriately once it has arrived. Sculptures are decorative art objects; they are not toys, functional household items, load-bearing objects or products meant to be handled. Damage caused by dropping, impact, mishandling, vibration, environmental conditions, unsuitable display or ordinary wear after delivery is not a defect.
Client is responsible for inspecting every delivered item immediately on receipt. Unless FE GOWNORA receives written notice of transit-related damage within 48 hours of delivery, the sculpture is deemed accepted by Client.
Client alone is responsible for customs duties, VAT, import taxes, brokerage charges, country-specific restrictions and regulatory compliance. FE GOWNORA is not responsible for customs delays, import holds, seizures or regulatory issues beyond its control, except where applicable law provides otherwise.
All production schedules, dispatch dates and delivery estimates are estimates only and are not guaranteed. FE GOWNORA will make commercially reasonable efforts to meet them and is not liable for delays caused by events beyond its reasonable control.
General
Because every sculpture is a one-of-one commission, an order may be cancelled for a refund of the amount paid, less a non-refundable $500 deposit, only before production begins. For the purposes of these Terms, production begins on the earlier of (i) FE GOWNORA starting to scan or photograph the gown, or (ii) seven days after FE GOWNORA receives the gown. The non-refundable $500 deposit is retained on any cancellation to cover intake, documentation and scheduling. Once production has begun the order cannot be refunded except where the law requires it or where FE GOWNORA materially fails to deliver the commissioned sculpture. FE GOWNORA will confirm in writing when production has started.
How FE GOWNORA Resolves Issues
If a production problem, defect claim, shipping issue or other concern arises, FE GOWNORA will decide on the appropriate remedy in good faith and in a commercially reasonable way, taking account of the nature of the issue and the circumstances. Because each commission is a bespoke work of art, FE GOWNORA cannot guarantee that a remade sculpture will be identical to an earlier version. FE GOWNORA shall have the first opportunity to repair, replace, remake or otherwise cure any alleged defect before any obligation to refund arises.
Chargebacks and Payment Disputes
Client agrees to raise any concern with FE GOWNORA first and to seek a resolution in good faith before opening a payment dispute. Improper or bad-faith chargebacks may result in recovery of reasonable costs and fees to the extent the law allows, and FE GOWNORA reserves the right to recover all associated costs, charges and attorneys’ fees arising from such chargebacks.
Every schedule, delivery estimate and quoted completion date is an estimate only and is not guaranteed.
FE GOWNORA will make commercially reasonable efforts to keep to estimated schedules. Delays can arise from the complexity of a piece, the availability of materials or other factors, and a delay on its own is not a breach unless it results from FE GOWNORA failing to act in good faith.
FE GOWNORA may decline, cancel or end any order at its sole discretion before dispatch, including where it suspects fraud, encounters abusive behaviour, faces production requirements that cannot be met, receives inaccurate information from Client, or has safety, legal or payment concerns. Where FE GOWNORA cancels an order before production for reasons not attributable to Client, FE GOWNORA will refund the amount paid.
If Client fails to collect, or to give return instructions for, any gown or other property for more than 90 days after FE GOWNORA gives notice that the order is complete or cancelled, FE GOWNORA may send written notice of its intention to treat the property as abandoned to Client’s last known email address. If Client does not reply within 30 days of that notice, FE GOWNORA may dispose of the property in accordance with applicable law. During this period FE GOWNORA may pause work and charge reasonable storage fees, and may deduct any unpaid storage fees from the proceeds of any sale or disposal. FE GOWNORA will comply with the bailment and unclaimed-property rules that apply.
Beyond the representations expressly set out in these Terms, FE GOWNORA gives no warranty regarding the final artistic result. TO THE FULLEST EXTENT PERMITTED BY LAW, ALL SCULPTURES AND SERVICES ARE PROVIDED “AS IS,” AND FE GOWNORA EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
To the fullest extent the law permits, and except in cases of gross negligence, wilful misconduct or fraud, FE GOWNORA’s total aggregate liability shall not exceed the greater of (i) the amount Client has paid, (ii) FE GOWNORA’s liability for the gown as expressly set out in Section 8, or (iii) the insurance proceeds actually recovered.
FE GOWNORA is not liable for sentimental loss, emotional distress, consequential or indirect damages, or damages arising from delay.
Client’s sole and exclusive remedy is limited, at FE GOWNORA’s sole discretion, to repair, replacement, recovery under insurance, a partial refund, or a refund of the amount paid.
FE GOWNORA may photograph, film, scan, render, display, reproduce, publish and otherwise use imagery of the gown, the sculpture and the making process for marketing, editorial, portfolio and archival purposes, provided no personally identifiable information is included unless Client has separately consented. Client may opt out of such use at any time by written notice given before publication. Client grants FE GOWNORA a non-exclusive, worldwide, royalty-free licence to photograph, display, reproduce, publish and otherwise use images of the submitted gown, the resulting sculpture and the production process for the purposes described in this Section, subject to any timely written opt-out. FE GOWNORA presents and promotes its sculptures as commemorative works of art that celebrate personal memories, milestones and life events; it does not market, offer or distribute them as replacements for, reproductions of, or substitutes for original garments or fashion products.
These Terms are governed by and construed under the laws of the State of New York. Any dispute arising out of or relating to FE GOWNORA’s commissioned works or services shall be resolved by binding arbitration in New York, New York. Nothing in this Section prevents either party from bringing a claim in small-claims court where the law allows, and Client keeps any statutory rights under consumer-protection laws that cannot be waived.
Client agrees that any dispute will be brought only on an individual basis and not as a claimant or class member in any purported class, collective, representative or consolidated proceeding.
Neither party may assign or transfer this Agreement, in whole or in part, without the other party’s prior written consent, and any attempted assignment contrary to this Section is void. Subject to that, this Agreement binds and benefits the parties and their respective permitted successors and assigns.
Any notice Client gives under these Terms must be in writing and sent to FE GOWNORA using the contact details published on the FE GOWNORA website.
FE GOWNORA acts as an independent contractor. Nothing in these Terms creates a partnership, joint venture or agency relationship between FE GOWNORA and Client.
FE GOWNORA is not liable for delay, damage or failure to perform caused by circumstances beyond its reasonable control, including carrier delays, weather, labour shortages, supply-chain disruption, equipment or software failure, acts of God, fire, flood, strikes, illness or government action. FE GOWNORA will make commercially reasonable efforts to limit the effect of such events. Estimated timelines are non-binding and may change.
These Terms are the entire agreement between Client and FE GOWNORA concerning the services provided and replace all earlier discussions, representations and understandings. If any provision is found invalid, unlawful, void or unenforceable, the remainder continues in force. A failure by FE GOWNORA to enforce any provision is not a waiver of it.
